Intellectual property rights and responsibilities for NFTs

purpose
This Intellectual Property (IP) Policy ("Policy") explains how intellectual property rights are handled in connection with the minting, listing, purchase, and sale of NFTs on the Pixpel platform (the "Platform"), operated by Pixpel FZ-LLC in the RAK Free Trade Zone, Ras Al Khaimah, United Arab Emirates.
Pixpel respects the rights of creators and rights holders. Users of the Platform must do the same.

User Responsibility

  • Users are solely responsible for the content they mint, list, display, or sell as NFTs on the Platform.
  • By minting or listing an NFT, you represent and warrant that:
    • You are the creator of the underlying content or
    • You have the necessary rights, licenses, and permissions to tokenize and distribute the content as an NFT.
  • You must not infringe any third-party copyright, trademark, publicity right, or other intellectual property right.

Ownership of NFTs

  • Purchasing an NFT on the Platform transfers ownership of the token itself, not the underlying intellectual property rights, unless explicitly stated by the creator.
  • Unless otherwise specified by the creator in writing, buyers of NFTs receive:
    • A limited, non-exclusive license to use, display, and resell the NFT for personal, non-commercial purposes.
  • Buyers do not receive:
    • Rights to reproduce, distribute, or exploit the underlying content commercially.

Prohibited Content

The following content is strictly prohibited on the Platform:

  • Content that infringes on third-party copyrights, trademarks, or other IP.
  • Unauthorized tokenization of copyrighted works (e.g., movies, games, music, brand logos).
  • Content that violates privacy, publicity rights, or contains defamatory material.
  • Illegal or offensive content, including hate speech, incitement to violence, or pornography.

Takedown Procedure (Notice & Action)

  • Interact in good faith when purchasing, selling, or funding projects.Rights holders may submit an IP infringement notice to Pixpel at legal@pixpel.io.
  • Notices must include:
    • Identification of the allegedly infringing NFT (contract address + token ID).
    • Proof of ownership of the rights allegedly infringed.
    • Contact information of the complainant.
  • Upon receipt of a valid notice, Pixpel may:
    • Suspend listing of the NFT.
    • Request counter-notice from the user.
    • Permanently remove the NFT if infringement is confirmed.
  • Pixpel acts as a neutral platform and will not adjudicate disputes beyond following the notice procedure.

Repeat Infringers

Pixpel may suspend or ban users who are repeatedly found to mint, list, or sell infringing NFTs.

Limitation of Liability

Pixpel reserves the right to:

  • Pixpel does not pre-screen all content and cannot guarantee that NFTs do not infringe third-party rights.
  • Pixpel shall not be held liable for infringing content uploaded by users.
  • Users remain solely responsible for ensuring compliance with IP laws.

Updates to this Policy

Pixpel may amend this Policy from time to time. Updates will be posted on this page with a revised "Last updated" date.
